Welcome to Cyberage. In these Terms of Service (“Terms”), “we”, “us”, and “our” refer to Cyberage. We operate this website and online store, including all related content, features, tools, products, and services (collectively, the “Services”) to provide you with an online shopping experience.
Our store is hosted on Shopify, which provides the e-commerce platform that enables us to offer the Services.
These Terms, together with any policies referenced here (including our Privacy Policy, Shipping Policy, and Return & Refund Policy), describe your rights and responsibilities when you access or use the Services.

By visiting, browsing, interacting with, or purchasing through the Services, you agree to these Terms and our Privacy Policy. If you do not agree, do not access or use the Services.

By using the Services, you confirm that you are at least the age of majority in your place of residence, or that you have provided consent for any minor dependents to use the Services on devices you own or control.
To browse the Site, create an account, or place an order, you may be asked to provide information such as an email address and billing, payment, and shipping details. You represent that the information you provide is accurate, current, complete, and that you have the right to provide it.
You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You may not sell, transfer, assign, or license your account to any other person.
SECTION 2 — PRODUCTS & INFORMATION
We aim to display product information as accurately as possible. However, colors and product appearance may vary depending on your device, screen, and settings. We do not guarantee that your device’s display will accurately reflect the product.
Product descriptions, specifications, availability, and pricing may be updated or changed at any time without notice. We may discontinue any product and may limit quantities purchased per person, household, or region where permitted.
SECTION 3 — ORDERS
When you place an order, you are making an offer to purchase. Cyberage may accept, decline, or limit any order at our discretion (including for suspected fraud, inventory issues, or pricing errors).
An order is not considered accepted until payment is processed and we send an order confirmation/acceptance. Please review your order carefully before submitting. After acceptance, changes or cancellations may not be possible.
If we refuse, modify, or cancel an order, we will attempt to notify you using the contact information provided at checkout.
Returns, refunds, and exchanges (if offered) are governed solely by our Return & Refund Policy.
You represent that purchases are for personal or household use only and not for resale, commercial distribution, or export.
SECTION 4 — PRICES, PROMOTIONS & BILLING
Prices, promotions, discounts, and product availability may change without notice. The price charged is the price displayed at the time you place the order and will be shown in your order confirmation.
Unless expressly stated otherwise, prices do not include taxes, shipping, handling, customs duties, or import fees.
We may run promotions that are subject to additional terms. If promotion terms conflict with these Terms, the promotion terms apply to that promotion.
You agree to provide accurate, complete, and current billing and account information and to promptly update it so we can process transactions and contact you when needed.
You represent that you are authorized to use the payment method provided and that your payment provider will honor charges incurred.
SECTION 5 — SHIPPING & DELIVERY
Delivery dates and transit times are estimates and not guaranteed. We are not responsible for delays caused by carriers, customs, weather, or events outside our reasonable control.
To the extent permitted by law, risk of loss passes to you once the order is handed over to the carrier.
SECTION 6 — INTELLECTUAL PROPERTY
All content included in the Services—including trademarks, logos, text, images, graphics, videos, audio, design, layout, and the selection/arrangement of these elements—is owned by Cyberage or our licensors and is protected by applicable intellectual property laws.
You may use the Services only for your personal, non-commercial use. You may not copy, reproduce, distribute, modify, create derivative works, publicly display, republish, download, store, or transmit any content from the Services without our prior written permission, except where such restriction is prohibited by law.
“Cyberage” names and brand elements are trademarks of Cyberage. Shopify’s name and logos are trademarks of Shopify. Other trademarks belong to their respective owners.
SECTION 7 — OPTIONAL THIRD-PARTY TOOLS
We may provide access to tools or services offered by third parties. We do not control these tools and provide them “as is” and “as available,” without warranties or endorsements.
Your use of optional third-party tools is at your own risk, and you are responsible for reviewing the third party’s terms.
Any new features or tools added to the Services in the future will also be subject to these Terms.

The Services may include links to third-party websites or content. We are not responsible for the content, accuracy, or practices of third parties.

SECTION 9 — RELATIONSHIP WITH SHOPIFY
Our store is hosted on Shopify, which provides the platform that enables us to offer the Services. However, purchases made through our store are transactions between you and Cyberage.
To the maximum extent permitted by law, you acknowledge that Shopify is not responsible for the sale, the products, or disputes arising from transactions between you and Cyberage, and you release Shopify and its affiliates from related claims.
SECTION 10 — PRIVACY
Personal information collected through the Services is handled according to our Privacy Policy. Because we use Shopify, Shopify may also collect and process information about your use of the Services to provide and improve the platform.

If you submit reviews, suggestions, ideas, proposals, or other content (“Feedback”), you grant Cyberage a worldwide, perpetual, irrevocable, royalty-free, sublicensable license to use, reproduce, modify, publish, distribute, and display the Feedback in any media for any purpose, including commercial purposes, unless prohibited by law.
You represent that you own or have the necessary rights to submit Feedback and that your Feedback does not violate applicable laws or third-party rights. We may remove Feedback at our discretion where permitted.

The Services may occasionally contain errors, inaccuracies, or omissions (including relating to product descriptions, pricing, promotions, shipping charges, transit times, or availability). We may correct these at any time without notice, including after an order is submitted, and may cancel orders where necessary.

To the fullest extent permitted by law, Cyberage (including our affiliates, directors, officers, employees, agents, contractors, service providers, and licensors) and Shopify and its affiliates will not be liable for any indirect, incidental, special, punitive, or consequential damages (including lost profits, lost revenue, loss of data, or replacement costs) arising out of or related to your use of the Services or products purchased through the Services.
Where liability limitations are not permitted, our liability will be limited to the maximum extent allowed by law.
SECTION 17 — INDEMNIFICATION
You agree to indemnify and hold harmless Cyberage and Shopify (and their respective affiliates, officers, directors, employees, agents, contractors, and service providers) from claims, losses, liabilities, and expenses (including reasonable attorneys’ fees) arising from your breach of these Terms, your violation of law, or your misuse of the Services.
SECTION 18 — SEVERABILITY
If any provision of these Terms is found to be unlawful, void, or unenforceable, the remaining provisions will remain in full force and effect to the maximum extent permitted by law.
SECTION 19 — WAIVER; ENTIRE AGREEMENT
If we do not enforce any right or provision under these Terms, that does not waive our right to do so later. These Terms and referenced policies constitute the entire agreement between you and us regarding the Services and supersede prior agreements or communications.
SECTION 20 — ASSIGNMENT
You may not assign or transfer your rights or obligations under these Terms without our prior written consent. We may assign or transfer these Terms as part of a merger, acquisition, reorganization, or asset transfer, where permitted by law.

These Terms and any dispute arising from or related to the Services will be governed by and construed in accordance with the laws of the Hong Kong Special Administrative Region, without regard to conflict of law principles, to the extent permitted by applicable law.
